7. Governing Law; Venue; Attorneys’ Fees.
Pennsylvania laws govern this transaction and any dispute related to this
purchase will be resolved in state and federal courts in Pennsylvania. The
prevailing party in any dispute is entitled to recover its reasonable
attorneys’ fees, other fees, and costs incurred in the dispute.
8. Removal. If the items purchased require
removal, will pay all expenses related to that removal, including any costs to
return the item site to the same condition it was in before you removed the
item. You accept responsibility for safety or environmental risks related to
uninstalling and removing the item. If you fail to remove the item within the
time specified by Seller, Seller may sell the item to another party. Depending
on the item type, Seller may require you to obtain a work permit in a form it
will provide you.
9. Miscellaneous. These terms are the entire
agreement and understanding between you and Seller relating to the items
purchased and bind you and your representatives, successors, and assigns. These
terms may be amended only by a signed, written agreement. No failure to enforce
or exercise any right under these terms constitutes a waiver. If any of these provisions
are invalid or unenforceable, then the rest remain in full force and effect.
Accepting the items purchased constitutes acceptance of these terms, as does an
electronic acceptance or signature – which is also binding.
Buyer/ Shipper must pick up within 7 days of winning the auction. Buyer must provide contact number of Shipper and BOL if using a Freight Company we also require a 24 hour announcement of arrival to warehouse with a timeframe estimate of arrival on the delivery day.
